Magistrate A. Akhiruddin @Boy Acho meted out the punishment on Delowar Hassan, 27, in accordance with Section 294 of the Criminal Procedure Code after considering the facts of the case , his background and mitigation.
Delowar, who works as a retail shop assistant with monthly salary of RM1,600, pleaded guilty to the charge.
In mitigation, Delowar, who was unrepresented, said he had a wife and child to support in Bangladesh.
He was charged with possession of 1,272 sticks of cigarettes of various brands, valued at RM128.76 and of which import duty of RM254.40 had not been paid.
The offence was committed at No. 18, Jalan Seroja 6, Bandar Baru Salak Tinggi , at 8 pm last Jan 16.
The charge was made under Section 135(1)(d) of the Customs Act 1967 which has been amended to provide for stiffer penalties on offenders.
The amended law provides a fine of not less than 10 times the value of the smuggled items or RM100,000 or nor less than six months imprisonment.
