Two Friends get Jail, Caning for robbing e-hailing Drivers

Date: 02 January 2019; Type: Legal News; Source: Bernama

KUALA LUMPUR, Jan 2 (Bernama) - The Sessions Court today sentenced two friends to three years’ jail and four strokes of the rotan after both of them pleaded guilty to two charges of robbing two e-hailing drivers at knifepoint last year.

Judge Mahyon Talib dispensed the sentence of three years’ jail and two strokes of rotan for each charge to R. Nanthakumar, 33, and C. Komagan, 41, and ordered for the sentence to run concurrently from the arrest date of Dec 11, 2018.

The two were charged with conducting group robbery on driver Ton Kwong Hong, 29, by taking two mobile phones and RM150 in cash, altogether worth a total of RM2,000, using a knife, in front of the San Peng flats at Jalan Dang Wangi here at 12.50pm on Dec 2, 2018.

They were also charged with conducting the same offence towards driver Mohamad Aniff Azahari Hamidi, 29, by robbing him of a wallet, two mobile phones and RM400 cash, altogether worth a total of RM1,000, at the carpark of a hotel in Jalan Pudu here at 2.20pm on Dec 4 last year.

They were charged under Section 395/397 of the Penal Code which carries a maximum penalty of 20 years’ imprisonment and can also include a fine or caning.

Deputy Public Prosecutor Siti Hajar Mohd Ashif earlier requested for the court to dispense a fitting punishment in the view of increasing robbery cases. However, the accused, who were unrepresented, pleaded for a lighter sentence as they were the breadwinners in their family.

According to the facts of the case, the accused disguised as customers by using the e-hailing app to book the rides and robbed the drivers of their valuables upon boarding the vehicles.
