Sessions Court Judge Awang Kerisnada Awang Mahmud meted out the punishment on Olivia Chong Oi Yun, 35, after finding the defence failed to create any reasonable doubts in the prosecution's case.
In his decision, Awang Kerisnada said the sentence represented public interest as well as the cries of the victims’ families who lost their children and husbands in the accident.
"The accused is irresponsible as she was drunk and caused the accident at 1.20 am when there were not many cars and in this case there were five victims, four were killed and one seriously injured.
“Three of the four died at the scene while another died in the hospital apart from the fifth who is now rendered disabled in the accident,” he said.
For the first charge of causing deaths, Olivia who worked at a private company here was sentenced to 10 years in jail and fined RM20,000 while for the second charge of causing serious injuries to the victim, her punishment was seven years jail and fined RM19,000.
The court ordered the two sentences to run separately from the date of sentence which means the accused will be imprisoned for 17 years and if she failed to pay the fine, she could be jailed up to one year.
The accused was represented by counsel Abdul Ghani Zelika who appealed for a reasonable sentence as his client was remorseful and cooperated with the authorities in the case.
Deputy public prosecutor Wan Muhammad Fitri Wan Azizan pressed to the court to impose the maximum sentence for causing so many deaths as well as serious injuries.
The trial which began in July saw 17 prosecution witnesses and two defence witnesses testifying and Judge Awang Kerisnada also visited the accident location.
According to the first charge, Olivia was accused of causing the deaths of Dicson Lim Kien Shing, 16, Hiew Nyuk Wei, 30, Clawence Wong Vui Kit, 21, and Chung Vui Chan, 21 while driving under the influence of alcohol in the incident at the parking area of BDC Commercial Centre on July 8.
For the second charge, the accused was found causing serious injuries to Chin Guan Xiong, 21 while driving under the influence of alcohol in the same incident.
